POPIA privacy notice
This notice explains how Lyle Jamane t/a 4th Industrial Solutions ("4th Industrial Solutions", "we", "us") collects and uses your personal information, as required by the Protection of Personal Information Act 4 of 2013 (POPIA).
1. Who we are (responsible party)
- Responsible party: Lyle Jamane t/a 4th Industrial Solutions (a sole proprietorship owned by Lyle Jamane), George, Western Cape, South Africa
- Information Officer: Lyle Jamane
- Contact: 065 768 6548 (cell & WhatsApp) · info@4irsolutions.co.za
2. What information we collect
- Enquiry details you send us: name, business name, phone number, email, the service you need, deadlines and your message.
- Service information you provide so we can do the work: ID numbers and copies of directors/owners, shareholding and beneficial ownership details, company registration documents, tax numbers and tax compliance status, bank confirmation letters, B-BBEE information, employee and payroll totals (for UIF/COIDA), addresses, municipal account details, business information for profiles and plans, and tender or RFQ documents.
- Payment records: invoices and proof of payment. We do not see or store your card details; card payments are processed by the payment provider (e.g. Yoco or SnapScan).
We do not ask for special personal information except where a tender form requires it, and only with your consent.
3. Why we use it (purpose and lawful basis)
- To reply to your enquiry and quote (your consent and steps before a contract).
- To deliver the service you asked for: registrations, affidavits, compliance packs, RFQs and tenders (performance of our agreement with you).
- To invoice and keep accounting and tax records (legal obligation).
- To send you tender alerts or renewal reminders only if you are a retainer client or have opted in. You can opt out at any time.
We will not sell your information or use it for unrelated marketing.
4. Who we share it with
- Government bodies you ask us to help you register or bid with, such as National Treasury (Central Supplier Database), SARS, CIPC, the Department of Employment and Labour (UIF) and Compensation Fund, the cidb, the NHBRC, any metropolitan, district or local municipality, provincial treasuries and departments in any of the 9 provinces, and other organs of state.
- Domain registrars and web/email hosts (e.g. Afrihost) and Google (Business Profile), only when you ask us to set up your website, domain, email or Google listing.
- A SANAS-accredited B-BBEE verification agency, or the bank you choose, but only when you ask us to arrange verification or help open an account.
- Service providers that help us run the business (operators), such as email, cloud storage and secure document-upload links, WhatsApp, website hosting (Afrihost), Google Analytics (only if you accept analytics cookies) and payment providers, who must keep your information secure.
- Anyone we are required to share it with by law.
AI Admin Assistant clients: when we handle your inbox, WhatsApp or invoices, the personal information of your customers stays in your own accounts. We process it only as your operator, under a written operator agreement and on your instructions (POPIA sections 20–21). We don't copy it into our own systems, use it for our own marketing or to train AI, and we delete any working copies when the service ends.
5. Cross-border transfers
Some of our tools (for example WhatsApp, email, cloud storage and Google Analytics) may store information on servers outside South Africa. We use reputable providers that are bound by data protection laws or agreements providing protection similar to POPIA (section 72).
6. How long we keep it
We keep enquiry details for up to 12 months if you don't become a client. When the work ends, we return or delete your documents unless you ask us in writing to keep them (for example for a retainer). Invoices and payment records are kept for as long as tax law requires (generally 5 years).
7. How we protect it
We use password-protected devices and accounts with two-factor authentication where available, share documents only with the parties named above, never keep your eFiling, CSD or bank passwords (you log in yourself), and never use your documents for anyone else. If we become aware of a security compromise affecting your information, we will notify you and the Information Regulator as required by section 22 of POPIA.
8. This website, cookies and analytics
This website has no user accounts and sets no advertising cookies. The enquiry form does not send or store anything on our server: it simply opens a pre-filled message in your own WhatsApp or email app, and nothing is sent until you press send there.
Google Analytics 4: we may use Google Analytics (provided by Google) to count visits and see which pages are useful, so we can improve the site. It loads and sets cookies (such as _ga) only if you click "Accept analytics" in the cookie notice. If you decline or ignore it, no analytics cookies are set. Analytics data is reported to us in aggregate (pages viewed, rough location by city or country, device type and how you found the site); we don't use it to identify you or for advertising. Google may process this data outside South Africa (see section 5). Your choice is saved in your browser, and you can change it any time with the "Cookie settings" link in the footer, by clearing your browser data, or with Google's opt-out add-on (tools.google.com/dlpage/gaoptout).
9. Your rights
You have the right to:
- ask what personal information we hold about you and get a copy;
- ask us to correct or delete information that is inaccurate, out of date or no longer needed;
- object to processing, and withdraw consent at any time (this does not affect processing already done);
- refuse direct marketing; and
- lodge a complaint with the Information Regulator.
To exercise these rights, contact our Information Officer using the details above.
